2.    Definitions
We use the following terms, among others, in this Privacy Statement:

a)    Personal data
Personal data is any information relating to an identified or identifiable natural person (hereinafter: your personal data). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

b)    Data subject
Data subject refers to any identified or identifiable natural person whose personal data are being processed by the controller.

c)    Processing
Processing refers to any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

d)    Controller
Controller refers to the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by EU or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

e)    Processor
Processor refers to a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

f)    Recipient
Recipient refers to a natural or legal person, public authority, agency or another body to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.

g)    Third party
Third party refers to a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

h)    Consent
Consent refers to any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

3.    Collection and storage of personal data as well as the nature and purpose of their use
a)    during visits to the website
When using our website, information is automatically sent to our website’s server by the browser used on your end device. This information is temporarily stored in a so-called log file. A commissioned data processing contract pursuant to Article 28 GDPR is concluded with the external service provider commissioned for the hosting. The following information is collected without you doing anything and is stored until it is automatically deleted:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of requested file,
  • Website from which the site is being accessed (referrer URL),
  • Browser used and, if necessary, your computer’s operating system and the name of your access provider.

The data mentioned are processed by us for the following purposes:

  • To guarantee a smooth connection to the website,
  • To guarantee our website can be used easily,
  • To evaluate system security and stability, and
  • For other administrative purposes.

The legal basis for the processing of data is Article 6(1)(1)(f) GDPR. Our legitimate interest results from the data collection purposes listed above. On no account do we use the collected data for the purpose of personally identifying you. We also use cookies and analysis services during visits to our website. You can find more detailed descriptions of this under clauses 8 and 9 of this Privacy Statement.

b) when making contact
To contact the ERDE team, it is necessary for you to provide us with the following information about yourself:

The data mentioned are processed by us or by a third party commissioned by us for the following purposes:

  • Processing your enquiry
  • Provision of specific information

Data processing for the aforementioned purposes is performed in accordance with Article 6(1)(1)(a) GDPR on the basis of your voluntarily granted consent.
Your personal data collected by us, when using the contact form, are archived and stored until the purpose has been achieved and the statutory erasure periods are satisfied.

c) when logging in to the internal area
For the registration in the internal area, you will be provided with the access data, which are adapted to you, at your request afterwards at the establishment of contact (point 3 c)). The corresponding data are:

  • username
  • password

The data mentioned will be processed by us for the following purposes:

  • Provision of specific advertising materials
  • Provision of general information

Data processing for the purpose of providing information is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO on the basis of your voluntary consent.
The personal data collected for logging into the internal area is archived and stored until the purpose has been achieved and the statutory deletion deadlines have been met.

4.    Transfer of data
No transfer of your personal data to third parties shall take place other than for the following purposes.
We only share your personal data with third parties if:

  • You have explicitly given your consent pursuant to Article 6(1)(1)(a) GDPR,
  • This is necessary for asserting, exercising or defending legal claims pursuant to Article 6(1)(1)(f)GDPR and there is no reason to believe that you have an overriding, protection-worthy interest for your data not to be passed on,
  • Passing on your data pursuant to Article 6(1)(1)(c) GDPR is necessary for compliance with a legal obligation, and
  • This is legally permissible and, in accordance with Article 6(1)(1)(b) GDPR, is necessary for the performance of a contract with you.

5.    Scope of processing of personal data
In principle, we only process our users’ personal data when it is necessary to do so in order to provide a functioning website and for the content and services we offer. The processing of personal data is normally only carried out with the user’s consent. One exception is where it is not possible to obtain consent beforehand for practical reasons and it is permitted by law to process the data.

6.    Legal basis for the processing of personal data
When we obtain consent from you for processing operations for personal data, Article 6(1)(a) GDPR forms the legal basis.
In the case of the processing of personal data which is necessary for the performance of a contract or pre-contractual procedures, Article 6(1)(b) GDPR forms the legal basis.
When processing personal data is necessary for compliance with a legal obligation to which we are subject, Article 6(1)(c) GDPR forms the legal basis.
If the processing is necessary for the protection of our legitimate interests or those of a third party and such interests are not overridden by your interests or fundamental rights and freedoms, Article 6(1)(f) GDPR forms the legal basis for the processing.

7.    Data erasure and storage period

Your personal data will be erased or blocked as soon as the purpose of storage ceases to apply. Storage can also be carried out if this is provided for by the European or national legislator in Union regulations, laws or other rules to which the controller is subject. Data will also be blocked or erased if the storage period prescribed by the aforementioned standards expires, unless continued storage of the data is necessary for conclusion or performance of a contract.

8.    Cookies
We use cookies on our website. These are small files which are automatically produced by your browser and are stored on your end device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not damage your end device and they do not contain any viruses, Trojans or other malware.

Information is stored in the cookie which is connected to the specific end device used. However, this does not mean that we receive direct knowledge of your identity.
The use of cookies serves to make our offer more attractive for you to use. So we use so-called session cookies to recognise that you have already visited individual pages of our website. These are automatically deleted after leaving our site.

Temporary cookies are used to improve the user-friendliness of our website and are stored on your end device for a specific set period. 9.    Analysis / tracking tools
The following tracking measures used by us are implemented on the basis of Article 6(1)(1)(f) GDPR. By using the following tracking measures, we want to ensure that the design of our website is appropriate to your needs and that the website is continually improved. We also use tracking measures to capture statistics regarding the use of our website and for the purpose of assessing and improving our offer for you. These interests shall be deemed legitimate within the meaning of the aforementioned regulation.

The respective data processing purposes and data categories shall be taken from the corresponding tracking tools.

Google Analytics
For the purpose of designing our website based on your needs and its continuous optimisation, we use Google Analytics, a web analysis service operated by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this context, anonymised user profiles are created and cookies (see clause 8) used. The information generated by the cookie regarding your use of this website, such as:

  • Browser type / version,
  • Operating system used,
  • Referrer’s URL (previously visited page),
  • Host name of the accessing computer (IP address),
  • Time of server request,

is generally transferred to a Google server within the EU or the European Economic Area and stored there. Storage in the USA is not excluded. The information is used for the purpose of analysing your use of the website, compiling reports on website activities and providing us with other services linked to website use and Internet use, for the purposes of market research and needs-based design of this website. This information will also be passed on to third parties if required by law or where third parties process these data on behalf of Google. On no account will your IP address be linked to other Google data. The IP addresses are anonymised so that assignment is not possible (IP masking).

10.    Social media links
We use links to the social network Facebook and the App Stores on the website on the basis of Art. 6 Para. 1 S. 1 lit. f DSGVO in order to raise awareness of the initiative. The underlying advertising purpose is to be regarded as a legitimate interest within the meaning of the DSGVO.

When you visit our pages, the link establishes a direct connection between your browser and the Facebook server. Facebook receives the information that you have visited our site with your IP address. 11.    Rights of data subjects
You have the right:

  • under Article 15 GDPR to demand information on your personal data processed by us. In particular, you can request information on the purposes of the processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing, or objection, the existence of a right to lodge a complaint, the source of your data if these data have not been collected by us, as well as the existence of automated decision-making including profiling and, where applicable, meaningful information on the details of this;
  • under Article 16 GDPR, to request the immediate rectification or completion of your personal data stored by us;
  • under Article 17 GDPR, to request the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
  • under Article 18 GDPR, to request restriction of processing of your personal data insofar as you contest the accuracy of the data, the processing is unlawful, but you oppose the erasure thereof, and we no longer require the data, but you need the data for the establishment, exercise or defence of legal claims or you have objected to processing pursuant to Article 21 GDPR;
  • under Article 20 GDPR, the right to receive the personal data, which you have provided to us, in a structured, commonly used and machine-readable format and the right to transmit those data to another controller;
  • under Article 7(3) GDPR, to withdraw the consent you have given to us at any time. As a result of this, we may no longer carry out the data processing based on such consent in the future and
  • under Article 77 GDPR, to lodge a complaint with a supervisory authority. For this, you can generally contact the supervisory authority of your habitual residence or place of work or of our company’s registered office.

12.    Right to object
Insofar as your personal data is processed on the basis of legitimate interests in accordance with Article 6(1)(1)(f) GDPR, you have the right pursuant to Article 21 GDPR to object to the processing of your personal data if there are grounds relating to your particular situation or you are objecting to direct advertising. In the latter case, you have a general right to object, which is implemented by us without need to indicate a particular situation.

Data security
During visit to our website, we use the SSL process (Secure Socket Layer) in connection with the respective highest encryption level which is supported by your browser. This is normally a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You will know whether an individual page of the website is encrypted by us by the closed depiction of the key or lock system in the bottom status bar of your browser.

Apart from that, we operate our own technical and organisational security measures to protect your data from accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by a third party. The security measures we use are continually improved according to technological advances.
